Seller Terms & Conditions

1. Who these terms apply to

These terms apply to every seller with an account on Gems Guild ("the platform"). By creating a seller account you confirm that you have read, understood and agree to be bound by them.

Gems Guild is a listing platform. We introduce buyers to independent sellers. We are not the seller, buyer, agent or escrow in any transaction.

2. Only natural gemstones

You may list natural gemstones only. Synthetic, lab-created, lab-grown, cultured, simulant, imitation, glass-filled, doublet, triplet and composite stones are strictly prohibited on this platform, whether or not they are labelled as such.

If you are uncertain whether a stone is natural, do not list it until you have had it tested by a recognised gemmological laboratory.

3. Full disclosure of treatments

Any treatment or enhancement a stone has undergone must be disclosed clearly on the listing. This includes but is not limited to heating, beryllium or other diffusion, irradiation, oiling or resin filling, fracture filling, dyeing, coating, and clarity enhancement.

A stone may only be described as "unheated", "untreated" or "no treatment" where that is true and you are able to substantiate it.

4. Accurate listings

Weight, dimensions, colour, clarity, shape, variety and origin stated on a listing must be accurate to the best of your knowledge.

Photographs and videos must show the actual stone being sold. Stock images, borrowed images, or media of a different stone are not permitted.

Lot listings must accurately state the number of pieces and total weight.

5. Certification

Where a listing states that a stone is certified, the certificate must be genuine, issued by the named laboratory, and must correspond to that specific stone.

You must be able to provide the certificate to the buyer on request. Altering, fabricating or reusing a certificate from another stone is grounds for immediate removal from the platform.

6. Pricing and transactions

Prices must be displayed honestly and in Sri Lankan Rupees. You are responsible for agreeing payment, delivery and any refund or return terms directly with the buyer.

Gems Guild does not process payments, hold funds, or guarantee any transaction. Any dispute arising from a sale is between you and the buyer.

7. Legal compliance

You confirm that you are legally entitled to sell the gemstones you list, that they were lawfully obtained, and that you comply with all applicable Sri Lankan laws governing the gem and jewellery trade, including the requirements of the National Gem and Jewellery Authority (NGJA).

Where a sale involves export, you are responsible for meeting all export, customs and tax obligations.

8. Your account

Seller accounts are granted by invitation and are personal to you. Do not share your login credentials or allow another trader to list under your shop.

You are responsible for all activity that takes place under your account. Keep your password secure and notify us immediately if you suspect unauthorised access.

9. Enforcement

We may edit or remove any listing, and suspend or terminate any seller account, at our discretion — in particular where we believe a stone has been misrepresented, a treatment undisclosed, or a synthetic offered as natural.

Serious or repeated breaches may be reported to the relevant authorities.

10. Responsibility

You are solely responsible for the gemstones you list and the statements you make about them. You agree to indemnify Gems Guild against any claim, loss or cost arising from your listings or your dealings with buyers.

The platform is provided as-is. We do not guarantee uninterrupted availability, and our liability to you is limited to the fullest extent permitted by law.

11. Changes to these terms

We may update these terms from time to time. The version you accepted is recorded against your account. Where changes are material we may ask you to accept the updated terms before continuing to list.
